We believe it is important to handle your personal data with care. This statement describes the manner in which your personal data is collected and processed on this website in accordance with the General Data Protection Regulation (entered into force on 25/05/2018) and with the Framework Act of 30 July 2018 on the protection of natural persons with regard to the protection of their data.
- Definitions
- Data Subject: The clients and relations of Mosa BV.
- Controller: Mosa BV. This implies the actions of all lawyers associated with the office under a service agreement as an associate lawyer or an agreement as a trainee, however limited to the actions in which they act for Mosa BV.
- Processor: All companies that Mosa BV calls upon and that may come into contact with the personal data of the clients.
- Personal Data: Any information relating to an identified or identifiable natural person, for example, the client, opposing parties, lawyers, third parties, etc. This can be direct, such as a name, national registration number, or photo. Sometimes it is also possible to identify a person indirectly through a combination of different types of information, such as address, age, and gender.
- Processing: An operation or set of operations performed on personal data or on sets of personal data, whether or not by automated means. For example, collecting, recording, organizing, structuring, storing, updating, or modifying… Any database, CRM, whether or not for lawyers, falls under this scope.
- Principles
Mosa BV attaches a very high value to the privacy of its clientele. For this reason, it wishes to provide its clients with the highest possible transparency regarding privacy.
We only process personal data that is necessary for the intended purposes. In doing so, we monitor the completeness and accuracy of your personal data.
In principle, we do not store your data longer than necessary for the purpose for which it was collected. In doing so, the necessary measures are always taken to protect your personal data. If identification is not required for these purposes, your personal data will always be pseudonymized or anonymized.
Mosa BV will take the appropriate measures to properly protect your data, store it correctly, and grant you the possibility to inspect, adjust, or, if necessary, erase this data. Mosa BV does what is necessary to prevent loss, misuse, and unauthorized access of/to your personal data. If a data breach occurs, you as the data subject will be notified without undue delay of a personal data breach if this breach entails a high risk.
Your personal data is only accessible to the persons who need it for the performance of their duties. Furthermore, everyone involved in processing your personal data, both own employees and external parties, is legally or contractually bound to treat it confidentially.
- Purposes and Grounds for Processing
Your personal data can reach us in various ways. For instance, we can request data directly through a contact form or certain documents. We only process your personal data if we have established a clear and justified purpose for it.
3.1. Processing Personal Data of Clients
To look after your file, you enter into an agreement with Mosa BV. This can be done by signing an engagement letter or accepting an offer via email. For the performance of the agreement, we process your personal data for the following processing purposes:
- To provide you with targeted advice;
- To conduct proceedings and represent your interests in court;
- To negotiate, mediate, or conduct arbitration;
- To provide you with an invoice and for the handling of payments.
For the above objectives, and depending on the specific processing, we may process ‘ordinary’ personal data. These include:
- Name;
- Email address;
- Telephone number;
- Address;
- Date of birth;
- National registration number.
In the context of managing files, we may also gain knowledge of sensitive personal data. This personal data is only processed if necessary for the management of your file. This concerns the following personal data:
- Criminal record, facts, or convictions;
- Personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a person, or data concerning health, or data concerning a person’s sex life or sexual orientation.
3.2. Social Media
Mosa BV uses various communication channels to get in touch with its clients. Mosa BV is also active on social media platforms, namely:
If you contact us via these channels in a private message (e.g., to ask a question or report a problem), your personal data will be processed. We only use that data to assist you further or to follow up on your request. After handling your request, these messages are stored by us for another 6 months.
If you respond to our public posts or share or like these posts, this data is visible to others. This public data is stored and is visible as long as it is not deleted by you.
As a social media user, your personal data is also processed by the social media platform in question. Mosa BV itself has no control over the further processing of your personal data by these platforms. The privacy statements of the social media platforms apply to those operations.
3.3. Minors
If we process personal data of minors, we always ensure that the minor is informed in a simple and understandable way about what he or she is giving consent for.
3.4. Prevention of Money Laundering and Terrorist Financing
The client provides cooperation to Mosa BV so that the latter can comply with its legal obligations regarding the regulations to prevent money laundering and terrorist financing. This implies, among other things, that the client shall provide a copy of their identity card and disclose their address upon first request.
The following ‘ordinary personal data’ is processed in this context:
- Surname and first name;
- Place and date of birth;
- Nationality;
- Card number;
- Signature of the holder;
- Image/Photo;
- National registration number.
3.5. Cookies and Tracking
We use cookies and related techniques on our website and in our online services. You will find all information about this in our cookie policy. In the cookie settings, you can grant or refuse permission per type of cookie.
- Transfer to Third Parties
Mosa BV attaches the greatest importance to your personal data and its protection. We do not pass on your personal data to other parties unless there is a legal basis for doing so. If we call upon an external company (processor) for the execution of a task or for drawing up a file, which would also come into contact with your personal data, we will ensure that the processors do not use the personal data for purposes other than those listed under section 3. Under no circumstances will your personal data be passed on to third parties for commercial purposes.
In principle, your personal data is only processed within the European Economic Area (EEA). If, in exceptional cases, your personal data is processed outside the EEA, this always happens in accordance with the provisions of the GDPR.
Data Processing Agreements
We always use a data processing agreement as a framework for agreements with our processors. This agreement is included as an annex to our main agreement.
- Rights of the Data Subject
The purpose of this privacy policy is to adequately inform the client about his or her rights. You have a number of rights regarding the processing of your personal data.
5.1. Right to Information and Access
You have the right to ask us about the personal data we hold about you, what it is, and how it is used. We can provide you with a free copy and further explanation. If the data subject requests additional copies, the controller may charge a reasonable fee based on administrative costs.
To ensure that the request for access has been made by you, we ask you to send a copy of your identity document with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number, and Citizen Service Number (BSN / National Number). This is to protect your privacy.
5.2. Right to Rectification and Supplementation
You have the right to ask us to correct and/or supplement your personal data if you believe it is incorrect or not up to date.
5.3. Right to Erasure (“Right to be Forgotten”)
You have the right to ask us to destroy your personal data when:
- The personal data is no longer necessary for the purposes for which it was collected;
- You withdraw your consent to the processing of your personal data, when the processing is based on this;
- You object to the processing (see below), and there are no overriding legitimate grounds for the processing;
- Your personal data is processed unlawfully;
- Your personal data must be erased to comply with a legal obligation resting on us.
We will erase your personal data in the above cases unless we are legally obliged to process your data or if the processing must take place in the public interest.
5.4. Right to Data Portability
When we process your personal data by automated means based on your consent or in the context of an agreement, you have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format, so that you can transmit it to another controller. You may also ask us to carry out this transfer in your place, insofar as this is technically possible.
5.5. Right to Restriction of Processing
You can ask us to restrict the processing of your personal data when:
- You contest the accuracy of that data;
- The processing is unlawful, but you do not want the data to be erased;
- We no longer need your data for the processing purposes, but you still need it in the context of a legal claim;
- You object to the processing of your data (see below), pending the answer to the question of whether there are interests that outweigh yours.
When processing is restricted, your personal data (with the exception of its storage) will only be further processed with your consent, for the protection of the rights of others, in the context of a legal claim, or in the public interest.
5.6. Right to Object
When your personal data is processed in the context of our tasks of public interest or public authority, you have the right to object to this for reasons related to your specific situation. Except when the public interest outweighs yours, we will cease processing your data.
5.7. Right to Withdraw Consent
For processing of personal data based on your consent, you can withdraw that consent at any time. In that case, we will stop processing your personal data. However, the processing of this data prior to the withdrawal of your consent remains valid.
